WRITTEN BY

INFORMATIVE NOTE

On May 22, 2026, the National Energy Commission (“CNE”) published in the Official Gazette of the Federation two resolutions issuing formats for applications related to power generation permits under the cogeneration modality and energy storage systems.

Both resolutions complement the Administrative Provisions of General Application published by the CNE on April 16, 2026 regarding cogeneration and energy storage systems, as part of the implementation of the new regime set forth in the Electric Sector Law and its Regulations.

On the one hand, the CNE published the resolution issuing the formats for applications related to power generation permits under the cogeneration modality, both for self-consumption schemes and generation for the Wholesale Electricity Market.

Likewise, formats related to permits incorporating energy storage systems and self-backup schemes were also published, including interconnected self-consumption projects and storage projects operating in connection with CENACE.

At RGR, we are currently analyzing the scope and regulatory implications of these resolutions and of the applicable requirements for power generation, cogeneration and storage projects. Should you require assistance regarding regulatory analysis, project structuring or the preparation of applications before the CNE, we would be pleased to assist.
