RESUMPTION OF TERMS AND TIMEFRAMES
On June 5, 2025, the “Official Resolution by which the terms and conditions for the receipt and processing of matters under the authority of the National Energy Commission are resumed” (the “Official Resolution”) was published in the Federal Official Gazette. This resolution formally lifts the suspension of terms and timeframes established following the dissolution of the Energy Regulatory Commission and the transfer of its powers and authority to the new National Energy Commission.
As of the effective date of the Official Resolution (i.e., June 6, 2025), the National Energy Commission shall receive, process, address, and resolve matters within its authority, except for certain exceptions expressly provided for in the Official Resolution. The Official Resolution also establishes specific mechanisms and terms for the regularization of obligations.
Of particular relevance, the Official Resolution provides that those who submitted proceedings before the now-extinct Energy Regulatory Commission prior to March 18, 2025, shall confirm their interest in continuing such proceedings before the National Energy Commission. This confirmation shall be carried out within 10 business days as from the effective date of the Official Resolution, either:
i) Electronically, through the Electronic Filing Office: https://ope.cne.gob.mx/, or
ii) In person, at the official address of the National Energy Commission, located at Blvd. Adolfo López Mateos No. 172, Ground Floor, Col. Merced Gómez, C.P. 03930, Benito Juárez, Mexico City. Office hours are Monday through Friday from 9:00 a.m. to 3:00 p.m. and from 4:00 p.m. to 6:00 p.m. (except on non-business days).
