Clean Energy Certificates (Certificados de Energías Limpias, “CELs”) are certificates granted by the National Energy Commission (Comisión Nacional de Energía) to Power Plants that generate electricity from Clean Energy sources and certify the amount of electricity generated from such sources. CELs are used to evidence compliance with the requirements associated with electricity consumption at Load Centers.
Pursuant to the Electricity Sector Law (Ley del Sector Eléctrico) and the applicable regulations, Suppliers, Qualified Users that are Market Participants, and End Users supplied through self-consumption are subject to CEL compliance obligations. In addition, CEL obligations may apply to certain arrangements that remain in effect under prior electricity legislation, including End Users supplied under Isolated Supply arrangements and holders of Legacy Interconnection Agreements that include Load Centers, in accordance with the provisions applicable in each case.
In this regard, on August 17, 2026, the Ministry of Energy (Secretaría de Energía, “SENER”) published in the Official Gazette of the Federation (Diario Oficial de la Federación) the “Resolution Establishing the Requirements for the Acquisition of Clean Energy Certificates for 2025 and 2026” (the “Resolution”).
Pursuant to the Resolution, SENER established that, for 2025 and 2026, obligated entities shall acquire the necessary CELs to cover 13.9% of the total electricity consumed at the corresponding Load Centers.
According to the recitals of the Resolution, SENER determined to maintain the previously established requirement, taking into consideration the current regulatory, technical and operational framework, as well as the objectives relating to the energy transition and the decarbonization of the electricity sector.
The Resolution became effective on August 17, 2026, the date of its publication in the Official Gazette of the Federation.
The Resolution further provides that the CEL acquisition requirements for 2027, 2028 and 2029 shall be subsequently determined and published by SENER through the corresponding legal instrument and based on the methodology to be issued by SENER for such purpose, in accordance with the Electricity Sector Law (Ley del Sector Eléctrico), the Energy Planning and Transition Law (Ley de Planeación y Transición Energética) and their respective regulations.
